E15 Misfueling Mitigation Plan

This is a model plan that companies may choose to adopt and submit to EPA for approval for the purpose of meeting the requirement for a misfueling mitigation plan under the E15 partial waivers. The Renewable Fuels Association is not responsible for implementation of this plan or liable for any failure to implement the plan. For a company adopting this plan, the plan should be read as including the company’s name in each place where “plan submitter” occurs.

Key elements of the plan include:

  • Clear label on fuel dispenser – 3-5/8” x 3-1/8” on upper two-thirds of fuel pump, other requirements also exist with respect to font size, color scheme, etc.
  • Product transfer documentation – must include all relevant dates, locations/addresses, and amount of ethanol in the fuel
  • Survey of compliance at retail dispensing facilities – fuel samples selected at retail outlets; fuel survey is required annually and will be conducted by the RFG Survey Association Inc. (RFGSA); survey will be collecting more than 7,500 samples each year of all gasolines available nationwide and will begin on May 1, 2012
