Judge Dismisses Landscaping Company's Defamation Lawsuit over Facebook Posts

Lawsuit accused woman of damaging Accurate Landscaping business through comments she posted on Facebook.

Judge Kenneth Brown dismissed the lawsuit against Kelleigh Murphy after a jury had been assembled. Murphy was accused by Manchester company Accurate Landscaping of damaging its business through comments she posted on the Facebook page of a Bedford, New Hampshire, moms' group about quotes for spring yard work.

"Kelleigh has always believed that this was a First Amendment issue, and in her First Amendment right to post on a closed Facebook moms' group questions she had about landscaping and her opinion regarding what her quote was," said Jaye Rancourt, Murphy's lawyer.

Robert Fojo, the attorney for Accurate Landscaping, said the company quoted Murphy a price of $3,400. In a Facebook post, Murphy called Accurate's quote the highest she received, Fojo said. But in another post, she said that the quotes ranged from $3,000 to $5,000, he said.

"Accurate's quote was only for $3,400, on the low end of that range," Fojo said. "So she falsely communicated that Accurate's quote was the higher of the two on that range, and that's a false statement of fact."
