OSHA Lowers Fine on Landscaping Company by $10,000

The company enhanced its safety program and agreed to unannounced monitoring of its work sites by OSHA.

The Occupational Safety and Health Administration (OSHA) lowered its fines on a Lake Worth, Florida landscaping company by more than $10,000 after one of the company’s workers died in August, according to a U.S. Department of Labor official.

In a conference call between the landscaping company, Focal Pointe LCC, and OSHA, the two sides settled the case with a $15,520 fine, down from OSHA’s original proposed penalty of $25,868, according to Department of Labor spokesman Michael D’Aquino.

The fines were lowered because Focal Pointe “made substantial changes to their safety and health program,” D’Aquino wrote in an email, including hiring a safety and health consultant. Focal Pointe also agreed to a six-month period with unannounced monitoring of its work sites by OSHA, according to D’Aquino.

On August 15, Grumaro Cruz Garcia, a 45-year-old from West Palm Beach, Florida, was electrocuted while working for Focal Pointe in Palm Beach. Garcia was standing at the top of a ladder in the 600 block of South County Road when the metal hedge trimmer he was holding touched a power line.
