Model legislation supported by the Accredited Snow Contractors Association (ASCA) has taken an important step forward in the Connecticut General Assembly.
The Snow Removal Limited Liability Act was approved by the Connecticut House of Representatives on April 24.
The ASCA’s model legislation, which has already been signed into law in Illinois and Colorado, prohibits clients from passing on their negligence through hold-harmless agreements and indemnification clauses.
Connecticut was the first state to pass a “reasonable care” statute, which required property owner to take reasonable care of their property in a reasonable time frame. Property owners were using indemnification clauses and hold harmless agreements to skirt this law, putting all liability on the contractor.
The proposed legislation addresses those issues.
